Although learned AGA is present, no one appeared on behalf of appellants even in the revised list. 2. This appeal had been preferred by appellants under Section 374(2) of Cr.P.C. against judgment and order dated 18.05.1983 passed by learned II-Additional Sessions Judge, Moradabad in Sessions Trial No.88 of 1982 convicting the appellants under Section 394 IPC with punishment of three and half years rigorous imprisonment. 3. Vide earlier order dated 21.08.2025, Chief Judicial Magistrate, Moradabad was directed to report regarding status of appellants. 4. In compliance of the said order, Chief Judicial Magistrate, Moradabd vide its report dated 03.09.2025, has apprised the Court that appellant no.2, namely, Hardwari had expired about 15-16 years ago. In sofar as appellant no.1, namely, Rewa Ram is concerned, he is alive. 5. In view of the report of Chief Judicial Magistrate, Moradabad dated 03.09.2025, the appeal is liable to be dismissed as abated qua appellant no.2. 6.
