This writ petition has been filed with the following prayer:- "I. Issue an order or direction to learned court below to decide the application Under Order 22 Rule 4 of C.P.C. bearing Case No. 168 of 2016 (Sharifun Begum Vs. Amanat and others) on 05.02.2019 in the Court of Civil Judge (Junior Division), Kushinagar, Padrauna within stipulated time granted by this Hon'ble Court." It is contended that the substitution application filed under Order 22 Rule 4 CPC is pending consideration. The sole prayer made in the writ petition is for expeditious disposal of the said application. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit or issuing notice to the sole respondent, the matter is being disposed of, at the admission stage, with a direction upon Civil Judge (Junior Division), Kushinagar, Padrauna to decide the substitution application filed under Order 22 Rule 4 CPC registered as Case No.168 of 2016, after hearing all the concerned parties, strictly in accordance with law expeditiously preferably within a period of four months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
