The petitioners are apprehending their arrest in connection with Giridih (Muffasil) P.S. Case No.130 of 2025, for offence registered under section 85, 81, 351(2), 115(2), 127(2), 127(4), 3(5), BNS, 2023, pending in court of learned S.D.J.M., Giridih.

Learned counsel for petitioners appearing through Video Conferencing (V.C.) submits that marriage of the informant was solemnized with the petitioner no.1 in the present case on 17.04.2025 and registered before the District Sub Registrar, Giridih and on the said certificate the mother of the girl has signed. He further submits that alleged kidnapping is of dated 04.03.2025 whereas the FIR has been lodged on 11.05.2025. He submits that the parents of the girl have not lodged the FIR instantly and concocted story has been made in the FIR and the petitioners have been implicated in this case and

even the father and mother of Gaurav have not been spared.
4. Learned State counsel opposes prayer and submits that it has come in paragraph no.23 of the case diary that the marriage was solemnized between Gaurav and the informant and the allegation is of cruelty is further made in subsequent paragraphs of the case diary.

The marriage certificate is annexed as Annexure-2 which clearly suggest that the marriage between the informant and Gaurav was solemnized on 17.04.2025 and mother of the girl has also signed as witness on the said certificate and the alleged kidnapping is of 04.03.2025 whereas the FIR has been lodged on 11.05.2025, I am inclined to grant anticipatory bail to the petitioners.

Accordingly, petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned S.D.J.M., Giridih, in connection with Giridih (Muffasil) P.S. Case No.130 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
