3 Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased toto issue a writ, order or direction more particularly one in the nature of writ of mandamus declaring the inaction of the respondents in not collecting the license fees in the manner provided thereof and grant the license in favour of the petitioners, the right to sell Indian Made Liquor/Foreign Liquor by shops as specified in the list appended to the Notification by the Prohibition & Excise Superintendent, Tirupati, Chittoor District in No. 22, dt.
24-3-2017 for the license period from 1-4-2017 to 30-06-2019 or 1-7-2017 to 30-6-2019 as the case may be in Sathyavedu Mandal/Circle, Chittoor District viz., "the authority under whose aegis the drawl of lots may take place, shall in the case of any shop where only bne application is received, declare the same in favour of that application, subject to the condition that all the other conditions have been fulfilled "as mandated under Rule 12 of the A.P.Excise (Grant of License of Selling by shop and conditions of License) Rules 2012, as the petitioners were found to be "single applicant" shopwise, as arbitrary, malafide, illegal and unconstitutional and grant IA NO: 1 OF 2017(WPMP 17036 OF 2017 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased direct the respondents herein to grant licences in favour of the petitioners herein, shopwise to sell Indian Made Foreign Liquor/Foreign Liquor by shop as specified in the notification by the Prohibition and Excise Superintendent, Tirupati, Chittoor published in A.P.Gazette No. 22, dt.24-3-2017 for the license period from1-4-2017 to 30-06-2019 or 1-7-2017 to 30-06-2019 as the case may be in Sathyavedu Mandal/Circle, Tirupati Division, Chittoor District as mandated under Rule 12 of the A.P.
