PUBLIC PROSECUTOR The Court made the following: ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/ Accused No.2 on bail in Crime No.198 of 2025 of Giddalur Urban Police Station, Prakasam District, was registered against the Petitioner/ Accused No.2 herein for the offences punishable under Section 109(1) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for short ‘the BNS’). 2 2. Heard the learned counsel for the petitioner, the learned Assistant Public Prosecutor. 3. Earlier, this Court, on 22.09.2025 in Crl.P.No.9433 of 2025, dismissed the request for grant of bail to the petitioner/Accused No.2. Accused No.1, against whom the main allegations were levelled, has already been enlarged on bail by the learned trial Court. The petitioner also approached the trial Court, but the trial Court dismissed the bail application on the ground that the earlier bail application filed by the petitioner had not been considered by this Court. The petitioner was arrested on 21.07.2025. He has been in judicial custody for the past 103 days. The charge sheet has already been filed, and the case is now at the PRC stage. Therefore, the possibility of the petitioner threatening witnesses, hampering the investigation, or tampering with evidence does not arise. The petitioner is permanent resident of Podalakuntapalle Village, Giddalur Mandal, Prakasam District. He has got fixed abode. 4. Considering the facts and circumstances of the case, the nature and gravity of allegations levelled against the Petitioner/ Accused No.2, this Court is inclined to enlarge the Petitioner/ Accused No.2. 5. In the result, the Criminal Petition is allowed with the following stringent conditions: i. The Petitioner/ Accused No.2 shall be enlarged on bail subject to he executing a bond for a sum of Rs.25,000/- (Rupees 3 twenty five thousand only), with two sureties each for the like sum each to the satisfaction of the learned Additional Judicial First Class Magistrate, Giddaluru. ii. The Petitioner/ Accused No.2 shall appear before the learned trial Court on every adjournment without fail. iii. The Petitioner/ Accused No.2 shall not commit or indulge in commission of any offence in future. _________________________ DR. Y.
