This writ petition has been filed with the following prayer:- "A) To direct the learned Civil Judge (Senior Division) Ghaziabad to decide the application 6-C-2 filed under Order XXXIX Rule 1 and 2 of The Code of Civil Procedure in Original Suit No. 1161/2024 (Babu Ram Tyagi and Ors. Versus Ghaziabad Development Authority, Ghaziabad) seeking Temporary Injunction in respect of suit schedule property in time bound manner as fixed by Hon'ble Court." 2. It is contended by learned counsel for the petitioner that application 6C2 filed under Order XXXIX Rule 1 and 2 of CPC in Original Suit No. 1161/2024 is pending consideration before trial court. 3. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon Civil Judge (Senior Division) Ghaziabad to decide the application 6C2 filed under Order XXXIX Rule 1 and 2 of Code of Civil Procedure in Original Suit No. 1161/2024 (Babu Ram Tyagi and others vs. Ghaziabad Development Authority, Ghaziabad), in accordance with law, after hearing all affected parties, preferably within a period of two months from the date of production of certified copy of this order. 4. With the aforesaid directions, writ petition stands disposed of. 5. It is made clear that this Court has not adjudicated the matter on merits.
