Govindgarh, District Jaipur (Rural), whereby the applicant-accused has charge under Section 318(4), 316(2), 338, 336(3), 340(2) and 61(2)(b) of BNS and Section 66C of IT Act.
2.
Learned counsel for the applicant submits that the applicant has been falsely implicated in the matter and the investigation against him is complete and he is no more required in investigation. He further submits that there are no chance of fleeing of applicant accused from the jurisdiction of this Hon’ble Court. The applicant does not have any criminal antecedents. He
[2025:RJ-JP:41510] (2 of 4) [CRLMB-12507/2025] also submits that the applicant undertakes not to repeat offence and cooperate with investigation/trial, which will take time.
3. First bail application on this applicant-accused was dismissed by this Court 05.08.2025 with following observations: (i) On basis of a report registered by Dy. Director, Social Justice and Empowerment Department about causing loss of more than ₹23,00,000/- to the Government exchequer, a report has been registered. In the report itself name of Vijay Kumar Bochlya and other persons were mentioned who misused their SSO ID and caused loss to State Exchequer by fabricated documents. (ii) During investigation, the role and involvement of these three petitioners along with other were established. The material on record clearly indicate that students were deprived from obtaining scholarship and a loss is caused to the State Exchequer. (iii) This is a case of serious fraud where investigation is still in progress, therefore, It is not a fit case to enlarge the petitioners on bail.
4.
Learned counsel for applicant submits that main accused is Vijay Kumar Bochlya, whose role and involvement is proved, whereas present applicant was working as Developer and Project Manger and his job is only to forward details received on portal and he was not involved in sanction process of scholarship. He also submits that after investigation, a charge-sheet has been filed and police has specifically pointed out the role and involvement of present applicant for limited purpose and no evidence more than what has been collected by police, is available to nail present applicant.
[2025:RJ-JP:41510] (3 of 4) [CRLMB-12507/2025]
5. Aforesaid contentions were opposed by learned Pubic Prosecutor and he submitted report received from C.O. Govindgarh, District Jaipur (Rural).
6.
Learned counsel for the applicant and learned Public Prosecutor. Perused the material available on record.
7. After dismissal of first bail application on 05.08.2025, a charge-sheet has been filed against Sharwan, Vijay Kumar and Balram Singh Gujar. In charge-sheet, police has found that a conspiracy was hatched between Vijay Kumar Bochlya, Karan and Sharwan to commit fraud, but when some issues have arisen in online application process then they contacted present applicant Balram Singh Gurjar, who knowingfully well about the shortcomings used his technical skills to create a space within the system, so that fraud may be committed. It appears that present applicant, who was a technical expert has assisted in getting technical approval of the scholarship forms. The involvement of present applicant is direct with use of technical expertise, and he facilitated other accused in committing fraud with public exchequer.
8. The facts and the material indicate that the alleged offence are of serious nature and role attributed to applicant is prima facie sufficient to consider complicity of applicant in the crime. Therefore, at this juncture, considering the evidence collected so far, this is not a fit case to enlarge the applicant accused on bail.
9. Considering the gravity of allegations and overall facts and circumstances of the case, it is appropriate to dismiss the bail application of the applicant accused at this stage.
[2025:RJ-JP:41510] (4 of 4) [CRLMB-12507/2025]
10. Accordingly, the instant 2nd application for bail filed under Section 483 of BNSS preferred by Balram Singh Gujar S/o Shri Ramavtar Gurjar, is hereby dismissed.
