The petitioner has been made accused in connection with Radhanagar P.S. Case No. 138/2024, for the offences registered under Sections 126(2), 103(1), 303(2) & 3(5) of the B.N.S., 2023, pending in the Court of Sri Alok Ojha, learned J.M.F.C., Rajmahal. On 02.09.2024, the petitioner alongwith co-accused persons mercilessly assaulted the informant, due to which he succumbed to his injuries. There is specific allegation against the petitioner that he had pressed the neck of the deceased. Learned counsel for the petitioner submitted that there is no injury on the neck of the deceased. It was further submitted that only abrasions were found there. Learned A.P.P. submitted that apart from the allegation that petitioner has twisted the neck of the deceased, and there is also allegation against him that he had ordered the co-accused persons to commit murder of the deceased. Considering the aforesaid facts, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected at this stage. (Ambuj Nath, J.) Jay/-
