Heard the parties.
2. The petitioner has been made an accused in connection with S.T. No. 36/2024, arising out of Balumath P.S. Case No. 109/2023, corresponding to G. R. Case No. 707/2023, for the offence registered under Sections 302, 307, 120B/34 of the Indian Penal Code and Sections 25(1-AB) & 27 of the Arms Act subsequently charge-sheet has been submitted under Sections 302, 120B/34 of the Indian Penal Code and Sections 25(1-A), 25(6), 25(7), 26(2) & 27/35 of the Arms Act and Section 17 of the C.L.A. Act, pending in the Court of learned Additional Sessions Judge-III, Latehar.
3. Bail application of the petitioner was earlier rejected by this Court vide B.A. No. 4936/2024 by order dated 09.12.2024.
4. On 12.08.2023, husband of the informant Rajendra Prasad Sahu, who was a goldsmith, was murdered by unknown persons near Central Academy Balumath. During the course of investigation, pistol which was used in committing murder of the deceased was recovered from possession of the petitioner.
5. Report regarding the stage of trial earlier called for, has been received. It appears that charge has been framed in this case on
06.07.2024. It further appears that out of 22 charge-sheeted witnesses, 09 witnesses have already been examined.
6. Considering the nature of allegation, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected once again.
7. Learned Trial Court shall expedite the trial and preferably conclude the same within six months from the next date fixed for recording of evidence.
