2025:JHHC:37759 1 IN THE HIGH COURT OF JHARKHAND AT RANCHI W.P.(S) No.7452 of 2025 ------ Md. Fajlu Rahman Ansari, S/o Abdul Majid Ansari, R/o Village Kendwa, P.O. + P.S. Shri Rajesh Ranjan, Central President, Jharkhand Mazdoor Kalyan Sangh, at Urjanagar, P.O. + P.S. Mahagama, District Godda, State Jharkhand – 814154. … … Respondents ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Md. Imran Ansari, Advocate For the Respondent(s): Mr. Rajesh Lala, Advocate ------ 02/ 16.12.2025 Heard learned counsel representing the petitioner and learned counsel representing the respondents. 2. By filing this writ petition, the petitioner has prayed for direction upon the respondents – Eastern Coalfields Limited (E.C.L.), a subsidiary of Coal India Limited, to issue joining letter in favour of petitioner’s son namely Md. Iqbal Ansari, in terms of the approved Policy, which is known as the Replacement Policy. It has been further 2025:JHHC:37759 2 prayed that the petitioner’s family should not be discriminated and his son be given appointment. 3. After hearing the parties, I find that admittedly the petitioner is not an employee of the Eastern Coalfields Limited, nor of the Holding Company i.e. Coal India Limited. He admittedly is the worker of a Government Contractor and General Order Supplier of the Eastern Coalfields Limited, namely Sarif Ansari, which is evident from Annexure-3 to this writ petition, which is a Letter issued by Sarif Ansari to the petitioner, to the effect that the petitioner will superannuate on 31.12.2020. Since the petitioner has superannuated, he now claims that his son has to be employed in terms of some Scheme. 4. Admittedly, there is no Scheme to suggest that the dependent of a Contractor-employee will be employed in the Eastern Coalfields Limited. Even if there is at all some arrangement / Scheme, that is absolutely in violation of the constitutional provisions. Further, the petitioner has got no right to seek appointment under the Eastern Coalfields Limited or the Coal India Limited. Thus, I find no merit in this writ petition. 5. Accordingly, this writ petition stands dismissed. (ANANDA SEN, J.) 16th December, 2025 Prashant. Cp-2 Uploaded on 17.12.2025
