Learned counsel for the petitioner and learned counsel for the respondent submit that the dispute is amicably settled and they have filed a joint application under Section 147 of the Negotiable Instruments Act, 1881. 3. Petition is arising from the concurrent finding in a proceeding in respect of an offence under Section 138 of the Negotiable Instruments Act, 1881. Petitioner is convicted and sentenced concurrently by the Trial Court and the Appellate Court. In terms of the joint memo, complainant/respondent has agreed to receive Rs.6,05,000/-, the fine amount imposed by the Trial Court. 4. It is submitted that Rs.4,40,000/- is transmitted to the account of the complainant through RTGS, Rs.1,51,250/- is deposited before the Trial Court and the complainant is at liberty to withdraw the said amount. It is also submitted that complainant has received Rs.13,750/- by way of cash. Considering the aforementioned submissions, settlement is accepted. Petition stands disposed of in terms of the settlement judgments of conviction under challenges are set aside.
