Heard the parties.
The petitioner has been made accused in connection with Mahuadanr P.S. Case No. 49 of 2022, for the offence under Sections 147, 148, 149, 323, 325, 341, 385, 387, 504, 506 & 435 of the Indian Penal Code and Section 17 of the CLA Act, pending in the court of learned Sub Divisional Judicial Magistrate, Latehar.
In the night of 14.05.2022, 05 to 06 extremists came to the construction site of the informant and demanded levy. They threatened the informant that construction should not be carried out unless the demand of levy was met. They also set ablaze two JCB machines, four water tankers, one poklane, one Tata 407 and one trailer. The security guards were also assaulted.
It was submitted that though the petitioner is named in the F.I.R., but no transaction of money had taken place. It was further submitted that similarly situated co-accused persons have been granted bail by the Coordinate Bench of this Court.
In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Sub Divisional Judicial Magistrate, Latehar, in connection with Mahuadanr P.S. Case No. 49 of 2022.
