This appeal is directed against the order dated 12.08.2025 passed in B.P. No. 662 of 2025 arising out of Barwadda P.S. Case No. 156 of 2025 by the learned Additional Sessions Judge- XVI, Dhanbad, whereby and where under the prayer for bail of the appellant has been rejected. 3. It has been alleged that in course of checking, two persons were apprehended and on their disclosure, four other persons were also apprehended with arms, ammunition and other incriminating articles. 4. Submission has been advanced by the learned counsel for the appellant that the appellant was arrested from his house and on a search only a mobile was recovered. It has been submitted that the appellant is in custody since 24.06.2025. Learned counsel adds that one of the co-accused from whose possession a country-made pistol was recovered, namely, M.D. Sarwar @ Md. Sarwar has been granted bail by a Co-ordinate Bench of this Court in Criminal Appeal (DB) No. 1138 of 2025. 5. Learned A.P.P. has opposed the prayer for bail of the appellant. 6. On consideration of the fact that one of the co-accused has been granted bail by a Co-ordinate Bench of this Court, as noted above and the fact that only a mobile was recovered from the possession of the appellant, we while setting aside the order dated 12.08.2025 passed in B.P. No. 662 of 2025 arising out of Barwadda P.S. Case No. 156 of 2025 by the learned Additional Sessions Judge- XVI, Dhanbad direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, 2025:JHHC:34868-DB 2 Dhanbad. 7.
