In the suit instituted by plaintiff, an application under Section 151 C.P.C. was moved seeking permission to cut the standing crops of Sugarcane over the field of the plaintiff. The trial Court allowed the application partially and directed that after harvesting the crop, the amount so collected from the sale of crops, shall be deposited in the court. Against the said order, defendants-respondents had preferred a civil revision No.5 of 2025 and by order dated 03.4.2025 the order passed by trial Court has been stayed. Sri Jitendra Singh, learned counsel appearing for respondent no.1 submits that the revision is fixed for 25.4.2025 and a direction may be issued to decide the revision instead. After hearing counsel for the parties and perusing the material on record, I find that once the revision filed by defendant No.1 is listed for hearing on 25.04.2025, it would not be appropriate to keep the writ petiton pending and the writ petiton is disposed of directing the revisional Court to take final call on the revision No.5 of 2025 on 25.04.2025 and decide the same, in accordance with law, after hearing all affected parties. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
