Heard the learned counsel appearing for the parties. 2. It is the case of the petitioner that the petitioner is the owner of the composite property containing both residential and commercial usage. It is also stated that the respondent-Bangalore Water Supply and Sewerage Board (for short 'Board') has specified dimension to install Rain Water Harvesting mechanism in respect of the premises as per Annexure-A to the writ petition. - 3 -

It is also forthcoming from the writ petition that the petitioner has complied with the direction issued by the respondent-Board for installation of Rain Water Harvesting equipment for the premises and thereafter, another second tank was installed during November 2022. In that view of the matter, as the petitioner herein has complied with the direction issued by the respondent- Board, even though a belated action on the part of the petitioner, however, the same cannot be considered as to take penal action against the petitioner despite the fact that petitioner has complied with all the requirements as required under the provisions contained under Annexure-A to the writ petition. 4.
In that view of the matter, the excess bill raised by the respondent-Board as per Annexure-G is hereby quashed. However, as the petitioner herein has deposited 25% of the arrears of the bill in terms of interim order dated 12.10.2022, same has to be adjusted towards the bills that may be raised by the respondent-Board in due

course. It is also to be made clear that no penal action shall be taken against the petitioner insofar as the installation of the second time belatedly, since the same would satisfy the norms of Annexure-A to the writ petition. With this observation, the writ petition is disposed of, quashing the letter dated 04.07.2022 issued by respondent No. 2 produced at Annexure-J.
