02/ 19.11.2025: Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Bashishthnagar P.S. Case No. 76 of 2023, registered under section 414 of I.P.C. and under section 15(C), 18(C), 25, 27(a), 28, 29 and 30 of NDPS Act, pending in the Court of learned Additional Sessions Judge-IV-cum-Spl. Judge, N.D.P.S., Chatra.

Learned counsel for the petitioner submits that the name of the petitioner has come in the confessional statement of the apprehended co-accused. He also submits that three of the co-accused persons have faced the trial and they have been acquitted by judgment dated 16.04.2025. He then submits that petitioner has got no criminal antecedent which is disclosed in para 11 of the petition. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that the petitioner has not appeared and in view of that case of the petitioner has been bifurcated.

Considering that name of the petitioner has come in the confessional statement of the apprehended co-accused, three of the co- accused persons have faced the trial and they have been acquitted by

judgment dated 16.04.2025 and petitioner has got no criminal antecedent which is disclosed in para 11 of the petition, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named, petitioner is
directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-IV-cum-Spl. Judge, N.D.P.S., Chatra, in connection with Bashishthnagar P.S. Case No. 76 of 2023, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
