Present applicant- Jakir is in judicial custody in relation to FIR dated 01.01.2025 bearing Case Crime no. 01 of 2025 registered at P.S. Piran Kaliyar, District Haridwar wherein the present applicant has been implicated for the offence punishable under Section 2/3 of the U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986. 4. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated which is evident from the fact that in seven cases the applicant is shown to be implicated and in all these cases the applicant is on bail. 5. In paragraph 5, the reference of all the seven cases has been given and on perusal of which it reveals that most of the cases pertains to the NDPS Act and one case pertains to the offence punishable under Sections 323, 504 and 506 IPC. 6. Mr. V.S. Pal, learned A.G.A. for the State seriously opposed the bail application by submitting that the applicant appears to be a habitual offender keeping in view the fact that seven cases are against him. 7. After hearing the argument of the learned counsel for the parties, and further taking into consideration the reference of seven cases out of which six 2025:UHC:1970 cases pertains to the NDPS Act, this Court is of the view that the applicant is not entitled for bail. 8. Accordingly, without expressing any opinion on the merits of the case, the bail application is rejected. (Rakesh Thapliyal, J.) 20.03.2025 Parul
