JUSTICE PRAVEER BHATNAGAR Order 22/04/2025 1. This criminal misc petition is preferred under Section 528 of BNSS for quashing of FIR No. 32/2025 registered at police station Malakhera District Alwar for the offence under Section 189(2), 115(2) and 126(2) of BNS on the ground of compromise entered between the parties. 2. It is contended by counsel for the petitioners that petitioners and complainant have amicably settled their dispute. The offences under Sections 189(2), 115(2) and 126(2) of BNS are compoundable offences. The dispute between the petitioners and the complainant is inter-se and not affecting the society at large, [2025:RJ-JP:16887] (2 of 2) [CRLMP-2272/2025] therefore on the basis of compromise entered between the parties, the FIR and all subsequent proceedings initiated on the basis of FIR may be quashed. 3. Learned counsel appearing on behalf of complainant concedes that complainant Mangala Ram and injured Sawai Singh have amicably settled their dispute and submitted the written compromise deed dated 04.04.2025, which bears the signatures of complainant Mangala Ram. The complainant and injured are present in person before the court and concede that if the proceedings against the petitioners are quashed then they have no objection. 4. Heard and perused the material available on the record. 5. Considering the fact that petitioners and complainant/injured have amicably settled their dispute and does not want to pursue the FIR, therefore in the light of judgment passed by Hon’ble Supreme Court in the case of Gian Singh Vs. State of Punjab and Another (2012) 10 SCC 303, this court deems it appropriate to quash the FIR No.32/2025 registered at police station Malakhera District Alwar for the offence under Section 189(2), 115(2) and 126(2) of BNS alongwith the entire criminal proceedings arising out of the aforesaid FIR. 6.
