JUSTICE A.GUNESHWAR SHARMA 21.02.2025 Present Mr.H.S.Paonam, learned senior counsel assisted by Mr.S.Gunabanta, learned counsel for the petitioner, Mr.Th.Sukumar, learned Government Advocate on behalf of respondent Nos.1-4 and Mr.S.Jasobanta, learned counsel for respondent No.5. MC (WP(C)) No.90 of 2025 is filed by the petitioner for correcting the cause title of the writ petition with respect to respondent No.2 as Principal Secretary/Commissioner/Secretary, (Departmental Enquiry), Government of Manipur instead of Principal Secretary/ Commissioner/ Secretary University and Higher Education), Government of Manipur and by altering the cause title there will be no change in the nature of the petition. Learned counsel for the respondents have no objection. Accordingly, MC (WP(C)) No.90 of 2025 is allowed. The writ petitioner is permitted to correct the cause title with respect to respondent No.2 as Principal Secretary/Commissioner/Secretary, (Departmental Enquiry), Government of Manipur. During the course of hearing Mr.H.S.Paonam, learned senior counsel for the petitioner submits that instead of pursuing the main relief the substantive prayer of the petitioner for quashing the suspension order dated 22.3.2024 and Memorandum dated 29.04.2024 and consequent orders, the respondents may be directed to complete the D.E. It is submitted that during pendency of the petition Inquiry Proceeding was completed on 28.01.2025 and in the circumstance, petitioner prays that the writ petition may be disposed of by directing the respondents to complete the disciplinary proceedings within a period of two months. Mr.Sukumar, learned Government Advocate submits that the writ petition may be disposed of with an innocuous order. However, the same may be directed to be completed within a period of four months. Mr.S.Jasobanta, learned counsel for respondent No.5 submits that this Court may pass any appropriate order. Recording the submissions made at the Bar, the writ petition is disposed of by directing the Disciplinary Authority to complete the Disciplinary Proceedings within a period of four months from the date of receipt of a copy of this order. It is made clear that this Court does not express any opinion on the merit of the case. Furnish a copy of this order to learned counsel for the parties.
