5 The instant Criminal Writ Petition under Article 226 of the Constitution of India has been filed by the petitioners for seeking appropriate directions to the official respondents to protect their life and liberty from the hands of private respondent No.5 and his agents, with further prayer to transfer the investigation of FIR No.29 dated 25.03.2025, P.S. Block Majari, SAS Nagari under Sections 74/126 (2)/115 (2)/351 (2) BNS, 2023 (Annexure P-6) outside the jurisdiction of District SAS Nagar, Mohali or the same be entrusted to Special REENA 2025.05.15 05:48 I attest to the accuracy and integrity of this document Chandigarh
CRWP-3183-2025 (O&M) 2 Investigating Team consisting of Senior Police Officials, as also to seek directions to the official respondents to decide the representation (Annexure P-8) submitted by the petitioners. 2. It is the submission of learned counsel for the petitioners that the petitioners were being harassed by respondent No. 5, and on the intervening night of 13/14.02.2025, the petitioner No. 1 was abused and assaulted by respondent No. 5 in the presence of the other petitioners who were also present in the office where the alleged occurrence took place, which was also duly recorded in the CCTV cameras present there. Post this incident, a complaint was made wherein it was also stated that the petitioners were being harassed by the agents of respondent No.5. In this regard, a representation dated 27.03.2025 (Annexure P-8) was also made to respondent Nos. 2 and 3. 3. Vide order dated 28.03.2025, this Court had directed for the impleadment of the concerned SHOs of Police Stations under whose jurisdiction the petitioners were residing. Simultaneously it was also asked of respondent Nos.2 and 3 to look into the representation, for taking appropriate steps, if any. 4.
In compliance of the said order, status report by way of an affidavit of Sh. Mohit Kumar Agarwal, PPS, Deputy Superintendent of Police, Sub Division Kharar-2, District SAS Nagar, Mohali on behalf of respondent No. 1 to 4-State has been filed. Referring to the same, learned State counsel submits that joint statement of the petitioners, who came present before the Inquiry Officer on 07.04.2025, was got recorded, wherein they stated that after the registration of FIR No. 29 dated 25.03.2025, they have not been threatened by the followers of respondent No. 5, but that prior to his arrest, he had made derogatory remarks against the petitioners and now his followers are circulating certain videos on social media related to the petitioners which are causing them mental harassment. CRWP-3183-2025 (O&M) 3 The petitioners also apprehend that respondent No. 5 can cause financial loss to them and make false representations against them. It is the further submission of learned State counsel that after the statement of the petitioners was recorded as mentioned hereinbefore, adequate measures were taken to allay their fears and protect their life and liberty, which have been duly recorded in the affidavit so filed on behalf of the respondent-State. Relevant portion of the same reads thus:

That in order to protect the life and liberty of the petitioners and to make sure that the followers of Respondent No. 5 do not become a victim to any kind of torture or harassment, the deponent has written a Letter No. 508-5A/DSP Kharar-2, Mullanpur dated 05.04.2025 to the Station House Officer's of Police Station City Kurali, City Kharar, Sadar Kharar and Maloya, Chandigarh, i.e. all the concerned police stations where the present petitioners reside.
That vide the above-mentioned letter, the deponent has shared the details of all the deponents and has asked them to do the needful so that no untoward incident takes place and provide proper support and co-ordination to all the petitioners in regard to their security. That the petitioners have also been informed that if they face any kind of threat from the followers of Respondent No. 5, they must inform the concerned Station House Officer immediately, so that further necessary action can be taken in accordance with law. 11. That it is worthwhile to mention here that as mentioned in the petition, the petitioner is an accused in FIR No. 128/2018 Police Station Zirakpur, SAS Nagar under Section 376, 420, 354, 294, 323, 506, 147, 149 IPC and Section 67 IT Act and has been convicted to life imprisonment in this case vide order dated 01.04.2025, pronounced by the Ld. Additional Sessions Judge, Mohali and is currently lodged in District Jail, Mansa. 12. That it is humbly submitted that the investigation in FIR No. 29 (Supra), is being carried out completely on the basis of merits and is not being influenced by any external party as alleged by the petitioners. CRWP-3183-2025 (O&M) 4 convicted and has been sentenced to life imprisonment in FIR No. 128/2018 (Supra), therefore, he will be brought on production warrant in the present FIR, for the proper investigation of the case. 13. That it is respectfully submitted that the deponent has great respect for this Hon'ble Court and the Order dated 28.03.2025 has been duly complied with. The deponent will make sure that all the orders passed by this Hon'ble Court are complied with in future also. 5.
In view of the aforesaid submissions and also the reply filed on behalf of the official respondents wherein it is stated that adequate measures have been taken to ensure the safety of the petitioners, no further directions are required to be passed in this matter. The petition is thereby disposed of as such. 6. However, it is made clear that in case a fresh cause of action arises, the petitioners would be at liberty to avail their remedies in accordance with law.
