The applicant is in judicial custody in FIR/Case Crime No.99 of 2024, dated 17.03.2024, under Sections 8/21/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (“the Act”), Police Station Piran Kaliyar, District Haridwar. He has sought his release on bail.

Heard learned counsel for the parties and perused the record.

According to the FIR, on 17.03.2024, 21.05 Grams Smack was recovered from the possession of the co-accused, who revealed that he has brought the Smack from the applicant.

Learned counsel for the applicant would submit that the co-accused, from whose possession the
2 Smack has been recovered, has already been granted bail; the applicant has been implicated merely based on the statement of the co-accused; there is no evidence against the applicant.

Learned State counsel would submit that based on the statement of the co-accused the applicant has been involved in the case, but she would submit that there are some cases registered under the Act against the applicant. It is also admitted that the co-accused has already been granted bail.

Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail.

The bail application is allowed.

Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount; to the satisfaction of the court concerned.
