THIS PETITION, COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE H.T. NARENDRA PRASAD ORAL ORDER This writ petition is filed under Articles 226 & 227 of the Constitution of India, seeking the following reliefs: “(i) Issue writ in the nature of mandamus or any other appropriate writ or direction, directing the respondent authorities to regularize the service of the petitioners from the date of their initial appointment, by considering the representations dated 01.04.2024 and 02.04.2024 vide Annexures K and K1. (ii) Issue writ in the nature of mandamus directing the respondent authorities to disburse incidental service benefits on regularizing the service of the petitioners.” 2. The case of the petitioners is that they were appointed as Underground Drainage Workers (Pourakarmikas) by the Mysuru City Corporation, in the - 5 - HC-KAR NC: 2025:KHC:32925 WP No. 14105 of 2024 years 2002-2007. Till today, they are working in the respondent – Corporation. Since they have completed more than ten years, they submitted representations dated 01.04.2024 and 02.04.2024 vide Annexures K and K1, seeking regularization of their services. Since the representations are not considered by respondent Nos. 3 to 5, they are before this Court. 3. The learned counsel for the petitioners submits that, in respect of similarly situated persons, this Court in W.P.No.14510/2024, disposed of on 06.12.2024, directed the respondents to consider the case of the petitioners. Hence, sought for allowing the writ petition. 4. The learned AGA for the State submits that, if this Court grants some reasonable time, the representations submitted by the petitioners would be considered in accordance with law. 5. In view of the above, without expressing any opinion on the merits of the case, the respondent Nos. 3 - 6 - HC-KAR NC: 2025:KHC:32925 WP No. 14105 of 2024 to 5 are directed to consider the case of the petitioners for regularization of their services in terms of the judgment of the Apex Court in the case of SECRETARY, STATE OF KARNATAKA V. UMADEVI (3) AND OTHERS reported in (2006) 4 SCC 1 and the Government Order dated 25.05.2006 and pass an order in accordance with law, as expeditiously as possible, not later than three months from the date of receipt of a copy of this order.
