Ct. No.4 D/L 20.06.2025 (Naba) 02 F.M.A. 811 of 2020 Ram Ratan Mundhra Vs. Union of India & Ors. (ASSIGNED) Mr. Jishnu Chowdhury, Ms. Pritha Basu ...for the Appellant Mr. Ranajit Chowdhury, Mr. Sudipto Chowdhury, Mr. Purnendu Modak, Ms. Sampoorna Saha ...for the Respondent no.2/Union Bank of India 1. After advancing some submissions, the learned senior counsel for the appellant realising his difficulty in taking this dispute further in a proceeding arising out of Article 226 of the Constitution of India submits that he would avail appropriate civil remedies. He, however, apprehends that his approach to a Court of competent civil jurisdiction would be met with the issue of limitation. 2. In the circumstances, though needless to say, we clarify that the time spent pursuing the present proceedings shall be available to the appellant to meet the issue of limitation/delay in the event the appropriate civil remedy is invoked by the appellant. 3. The appeal is dismissed with liberty as prayed for. (Madhuresh Prasad, J.) (Supratim Bhattacharya, J.)
