JUSTICE SACHIN SHANKAR MAGADUM ORAL ORDER This petition is filed by the husband seeking quashing of the proceedings pending in C.C.No.7637/2024 for the offences punishable under Sections 498-A and 504 of IPC. 2. Today, a joint affidavit has been filed by the petitioner/husband and respondent No.2/wife. In the said affidavit, respondent No.2, who is the complainant, has acknowledged the terms and conditions therein. On being queried, she submits that she has returned to her - 3 - HC-KAR NC: 2025:KHC:33363 CRL.P No. 8872 of 2025 matrimonial home, is presently residing with her husband, and desires that the dispute be given a quietus. She further states that she has no objection to quashing of the proceedings. 3. In view of the amicable settlement between the parties and the fact that respondent No.2 has resumed cohabitation with the petitioner, this Court finds it just and appropriate to put an end to the criminal proceedings. Though the offence punishable under Section 498-A of IPC is non-compoundable, having regard to the nature of the dispute, which is essentially matrimonial, this Court deems it fit to exercise its inherent jurisdiction to quash the proceedings in order to prevent abuse of process of law and to secure the ends of justice. 4. Accordingly, this Court proceeds to pass the following: - 4 - HC-KAR NC: 2025:KHC:33363 CRL.P No. 8872 of 2025 ORDER (i) The petition is allowed; (ii) The proceedings in C.C.No.7637/2024 pending on the file of the learned II Additional Chief Judicial Magistrate, Bengaluru, for the offences punishable under Sections 498-A and 504 of IPC, insofar as they relate to the petitioner, are hereby quashed.
