Prayer made in the instant petition is for issuance of a writ of mandamus commanding the respondent-Development Authority to reconstruct the godown of the petitioner and pay a suitable amount as compensation. 2. The case of the petitioner is that he was constructing a small godown in pursuance of a scheme named Rashtriya Khadya Suraksha Mission, launched by U.P. Agricultural Department. The respondent-Development Authority passed an order stopping the constructions and thereafter the officials of the Development Authority came on the spot and demolished the building under construction. He concedes that in the scheme, there is no provision for exemption from obtaining sanction of the building plan from the Development Authority. Admittedly, the area falls within the limits of the Development Authority. He submits that the petitioner would submit building plan for sanction of the godown and the Development Authority may be directed to consider the same within a specific time frame. 3. Sri J.N. Maurya, learned counsel for the respondent- Development Authority, states that in case any plan for sanction of godown is submitted, the same will be considered expeditiously. 4. In view of the above, we dispose of the instant petition by providing that in the event any application is submitted by the petitioner for sanction of building plan, the respondent- Development Authority will consider and decide the application within four weeks.
