Therefore, without delving into the merits of the case and since the principles of natural justice have been violated, the impugned order is set aside. Accordingly, this Writ Petition is allowed. The matter is remitted back to the 1st respondent for fresh consideration and the 1st respondent shall afford an opportunity to both parties to make their submissions and shall thereafter pass a speaking order within one month from the date of deposit of Section 17(b) arrears. It is needless to state that the petitioner shall comply with Section 17(b) and pay the wages pending the writ petition. The 1st respondent shall take up the hearing only on the payment of the 17(b) wages. No costs.
