THIS APPEAL, COMING ON FOR FINAL HEARING, THIS DAY, JUDGMENT WAS DELIVERED THEREIN AS UNDER:
CORAM: HON'BLE SMT. JUSTICE LALITHA KANNEGANTI
ORAL JUDGMENT
Aggrieved by the award passed in MVC No.1323/2022 dated 05.06.2023 by the XIV Additional Small Cause Judge and ACMM and Member-MACT, Bengaluru, whereby the Tribunal had granted an amount of Rs.13,19,400/- as compensation, the claimants are before this Court seeking enhancement of the compensation.
2. The claim petition was filed under Section 166 of the Motor Vehicles Act, 1989, seeking compensation of an

amount of Rs.50,00,000/- for the death of the deceased in the road traffic accident.
3. The Tribunal has awarded the compensation as per the table given below: Sl. No. Heads
Compensation Awarded
1. Towards loss of dependency : Rs. 11,66,400/-
2. Towards loss of Consortium to the petitioner No.1 : Rs. 40,000/-
3. Towards loss to estate : Rs. 16,500/-
4. Towards transportation of dead body funeral and obsequies ceremony expenses : Rs. 16,500/-
5. Towards loss of love and affection to petitioner Nos.2 and 3 (Each Rs.40,000/-) : Rs. 80,000/- Total : Rs. Rs.13,19,400/-
4. The learned counsel appearing for the claimants submits that the accident had taken place in the year 2022 and the Tribunal had taken the income at Rs.12,000/-, whereas the Tribunal ought to have taken the income at Rs.15,500/-.

Therefore, it is further submitted that on all other counts, the compensation needs to be enhanced.
5. The
learned counsel appearing for the respondent/Insurance Company submits that the Tribunal had granted a just and reasonable compensation and no interference is called for. 6. Having heard the learned counsels on either side, perused the material on record. Then coming to the compensation, the accident had occurred in the year 2022. As per the chart prepared by the Karnataka State Legal Service Authority, the notional income for the year 2022 is an amount of Rs.15,500/- per month. As on the date of accident the deceased was aged about 56 years, 10% future prospects would come to an amount of Rs.1,550/- and the total monthly income come to an amount of Rs.17,050/- (Rs.15,500 + Rs.1,550). As there are three claimants, this Court is inclined to deduct 1/3rd towards personal expenses i.e., Rs.5,683/-. Then, the contribution to the family would be an amount of Rs.11,367/- (Rs.17,050-Rs.5,683). Hence, under the head of loss of dependency, this Court is granting an amount of

Rs.12,27,636/- (Rs.11,367 x 12 x9). Towards loss of consortium, this Court is granting an amount of (Rs.44,000 x 3) = Rs.1,32,000. Towards funeral expenses, this Court is granting an amount of Rs.36,000/-. 7. In the light of the law laid down by the Hon'ble Supreme Court in the case of V.MEKALA VS. M. MALATHI AND ANOTHER1, the claimant is entitled for an amount of Rs.10,000/- towards legal expenses. 8. The claimant are therefore, entitled to the compensation under the following heads: Sl. No. Heads
