Heard Shri Hari Agrawal, learned counsel for the petitioners. Also heard Shri S.S. Baghel, learned Dy. Govt. Advocate for the State/respondent nos. 1 to 4 as well as Shri Prashant Dansena, learned counsel for the respondent nos. 5 & 6. 2. The present petition has been filed with the following prayer:- I. A writ and/or an order in the nature of appropriate writ to issue quashing the FIR No. 0847/2023 dated 07.12.2023 registered at Police Station Raigarh, District Raigarh (C.G.) for the offence punishable under Section 420 read with Section 34 of IPC, in the interest of justice. II. Any other relief which this Hon’ble Court may deem fit in the facts and circumstances of case.” 3. Learned counsel for the petitioner submits that the private respondent is the real brother and sister-in-law of the petitioner. It is stated that a monetary dispute had arisen between the parties, which has already been settled, and the amount due has been paid by the petitioner to 4 respondent Nos. 5 and 6. In this regard, a compromise was entered into, and an affidavit affirming such compromise was filed by respondent No. 5 before the Station House Officer of the concerned Police Station on 16.01.2024. A copy of the said affidavit has been annexed at page No. 18 (Annexure P/2). However, despite the said fact, the Investigating Officer has not submitted the police report under Section 173(2) of the Cr.P.C. till date. 4. We have heard learned counsel for the petitioner and perused the documents. 5. Considering the aforesaid facts and circumstances of the case, the parties are directed to appear before the Investigating Officer, who shall, after verifying the compromise deed filed and submit a police report in accordance with law before the Court concerned within a period of two weeks. 6. In view of the aforesaid, the concerned Superintendent Of Police is directed to ensure proper police report filed on the basis of compromise entered between the parties and the parties are directed to appear before the concerned Investigation Officer within a week from today. 5 7. Accordingly, the present petition stands disposed of. 8. Certified copy of the documents annexed in the petition may be returned back to the counsel for the petitioner/ State after obtaining the photocopy of the same.
