JUSTICE HASMUKH D. SUTHAR Date : 25/07/2025 ORAL ORDER By way of present petition, the petitioner – party in person has sought for the following reliefs:
“That this Hon’ble Court order competency certificate committee (Respondents) to issue the Competency Certificate to the petitioner;” Heard petitioner – party in person at length and learned advocate Mr. P.R. Abhichandani appearing for the respondent. Perusing the record it appears that the respondent – Committee has not granted permission to the petitioner to appear as party in person. The opinion of the respondent – Committee as regards the competency of the petitioner to appear as party in person reads as under:
“On perusal of record and on inquiry, it appears that; The Party-in-person viz. Ms. Madhuri Janardanbhai Trivedi has submitted “Undertaking” to the effect that she will maintain decorum of the Honourable Court including conduct and discipline and will not use objectionable and unparliamentary language while making submission. Her Educational Qualification is Masters in Computer Info. Science. She has an ability to understand English language. Page 1 of 2

She is not able to explain the facts of this matter properly and has no basic knowledge about the law and legal provisions. Hence, the Committee is of the considered view that Party- in-person viz. Ms. Madhuri Janardanbhai Trivedi, is not competent to assist the Honourable Court in Person. She is advised to engage an Advocate of her choice or to approach the High Court Legal Services Committee for legal aid.” While a specific query was put to the petitioner – party in person as to whether she wants to engage an Advocate of her choice or to approach the High Court Legal Services Committee for legal aid, she has refused to either engage an advocate of her choice or to approach the High Court Legal Services Committee for legal aid also.
Since the petitioner has shown her dissatisfaction with the opinion of the respondent – Committee and as she wants to appear only as party in person, she is ready and willing to once again approach the authority on administrative side and wants to show her competency to assist the Court. Hence, no case is made out to interfere with the order passed by the respondent – committee. However, it is kept open for the petitioner – party in person to approach the Registrar General, Gujarat High Court on administrative side to seek Competency Certificate from another committee. If such request is permissible under the Gujarat High Court Rules and if any such request is made by the petitioner for getting competency certificate then the Registrar General is directed to decide the same independently on its own merits. This Court has not expressed any opinion on merits qua competency of petitioner – party in person. With aforesaid direction, present petition is disposed of. (HASMUKH D. SUTHAR, J.)
