JUSTICE SANJAY PARIHAR, JUDGE ORDER 06.08.2025 This petition, by the Union Territory of India under Article 226 of the Constitution of India, is directed against an order dated 20.06.2024 passed by the Central Administrative Tribunal, Jammu (“the Tribunal”) in O.A No. 1346 of 2021 titled “Bali Ram Versus Union Territory of J&K and others”, whereby the Tribunal while allowing the writ petition directed the petitioner herein not to recover any amount from the salary or pensionary benefits of the respondent having been received by him during his lifetime on account of wrongful benefit of SRO 59/149 of 1973. The issue raised in this petition is fully covered by judgment dated 04.04.2024 passed in WP(C) No. 2416/2024 c/w WP(C) No. 3034/2024. In view of the legal position clarified in the judgment dated 04.04.2025 (supra), we find no merit in the instant petition and the same is, accordingly, dismissed.
