Heard the parties.
2. The petitioner has been made accused in connection with Pakur Town P.S. Case No. 245/2024, for the offences registered under Section 303(2) of the B.N.S., 2023, pending in the Court of learned C.J.M., Pakur.
3. In the night of 29.09.2024, two Scorpios, belonging to the informant and his friend, were stolen by unknown persons from Bhagatpara, Pakur.
4. It was submitted that nothing incriminating has been recovered from the possession of the petitioner. It was further submitted that though the police has shown that on the pointing out of the petitioner, some motor parts of the vehicle was recovered but confession of the petitioner was recorded subsequent to the recovery of the motor parts of the vehicle. It was finally submitted that co-accused namely Md. Ali @ Raja has been granted bail by the co-ordinate Bench of this Court in B.A. No. 251/2025.
5. In view of the submissions made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned C.J.M., Pakur in connection with Pakur Town P.S. Case No. 245/2024.
