Heard the parties.

By filing this Criminal Miscellaneous Petition, the petitioner prays for modification of condition imposed by this Court while granting anticipatory bail vide order dated 10.07.2025 passed in A.B.A. No.2751 of 2025.

The modification which the petitioner seeks is with respect to one of the conditions that the petitioner shall appear before the Investigating Officer once in every three weeks till submission of the Charge Sheet / Final Report.

Learned senior counsel representing the petitioner submits that in one of the cases i.e. Seraikela (Mahila) P.S. Case No.01 of 2025, charge sheet has already been submitted, thus it is not necessary for the petitioner to appear before the Investigating Officer in connection with Seraikela (Mahila) P.S. Case No.01 of
2025. He submits that so far as other case i.e. Seraikela R.I.T. Police Station Case No.98 of 2024 is concerned, charge sheet is yet

to be submitted, thus the petitioner has to appear before the Investigating Officer. He submits that since the petitioner is in the Indian Army, it is difficult for him to appear on every three weeks, as he is presently posted in Assam and is also undergoing compulsory Military Training Programme at Dr. Ambedkar Nagar, Madhya Pradesh.

Learned A.P.P. representing the State has got no objection to the aforesaid prayer.

Considering the aforesaid submission and the facts stated above, I am inclined to modify the order itself. If the Investigating Officer feels necessary to put questions to the petitioner in respect to the aforesaid case, he is at liberty to do the same virtually, to which the petitioner will cooperate. Thus, the
order dated 10.07.2025 passed in A.B.A. No.2751 of 2025, stands modified, only to the aforesaid extent.

Accordingly, this Criminal Miscellaneous Petition stands
disposed of.
