The instant Criminal Appeal under Section 374(2) of Code of Criminal Procedure has been filed by the sole appellant Kanhaiya Lal against the judgement and order dated 03.09.2014 passed by the Special Judge(Prevention of Corruption), Gorakhpur in Special Trial No. 17 of 1999 whereby the appellant has been convicted and sentenced to four years rigorous imprisonment and a fine of Rs. 15,000/- each under sections 7 and 13(1)(D) read with Section 13(2) of Prevention of Corruption Act and in case of default in payment of fine, he was further directed to undergo imprisonment of six months each. Vide order of this Court dated 05.09.2024, the Chief Judicial Magistrate, Gorakhpur was directed to ascertain the living status of the appellant. Pursuant to the aforesaid order of this Court, the Chief Judicial Magistrate, Gorakhpur has sent his report dated 09.10.2024 indicating therein that sole appellant Kanhaiya Lal died on 28.04.2021. The status report is on record. In view of the above, the instant Criminal Appeal stands abated. Since the order dated 24.04.2015 granting bail to co- accused Sushil Chandra Mishra, appellant in connected Criminal Appeal No. 3548 of 2014 was passed in the instant appeal, therefore, the record of this case shall remain connected with the aforesaid criminal appeal No. 3548 of 2014.
