This is the first bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sahita, 2023 for grant of regular bail to the applicant, who has been arrested in connection with Crime No.33/2025 registered at Police Station Panduka, District Gariyaband (C.G.), for the offence punishable under Sections 318(4), 336(3), 338, 340(2) of the Bharitya Nyaya Sanhita, 2023. 2. Case of the prosecution, in brief, is that on 13.05.2025 written DEEPTI JHA NIRALA Digitally signed by DEEPTI JHA NIRALA
2 complaint submitted by one Shri Mahendra Sahu before the concerned police station in respect of the incident alleged to have been took place between 25.04 2025 to 05.05.2025. On the basis of written complaint FIR has been lodged on 14.05.2025, wherein, it was alleged that the applicant had obtained a sum of 16,00,000/- from complainant on the pretext of securing employment on the post of Data Entry Operator in the Chhattisgarh State Power Distribution Company Limited (C.S.P.D.C.L.) for his son Himanshu Sahu, daughter-in-law- Menka Sahu, and brother-in-law- Khemendra Sahu. It was further alleged that the applicant had obtained Rs.29,00,000/- from one Goyal Sonkar, an acquaintance of the complainant, for securing employment in the post of Data Entry Operator in C.S.P.D.C.L. for Leena Sonkar, Vaishali Sonkar, and Khushi Dewangan, and for securing employment in the post of Junior Engineer for Ghanshyam Sonkar. Additionally, it was alleged that the applicant had taken Rs.5,00,000/- from Ajay Kumar Sahu for securing the post of Data Entry Operator, and Rs.5,00,000/- from Rahul Sahu for securing the post of Data Entry Operator for their respective wives, Smt. Anju Sahu and Smt. Ekta Sahu.
On the basis of the aforesaid allegations, it was asserted that the applicant had dishonestly obtained an aggregate sum of Rs.60,00,000/- from various persons on the false pretext of providing employment in C.S.PD.C.L.
3. Learned counsel for the applicant submits that the present applicant is innocent and has been falsely implicated in crime in question. He further submits that present applicant is the only bread earner of his family. It is further submitted that no money has been deposited in his account and there is no documentary evidence to show that such money has been received by him. It is further submitted that the
3 applicant is in jail since 14.05.2025, conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the applicant. 4. On the other hand, the learned Deputy G.A. opposes the bail application and submits that the cheques were also issued by the complainant to the said person for demanding the money, but the same was not presented for encashment. He further submits that applicant has taken huge amount from various persons. It is further submitted that charge sheet has already been filed in the present case before the competent Court, therefore, applicant is not entitled to be released on bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Taking into consideration the fact and circumstances of the case, particularly considering the fact that applicant is said to have taken allegedly Rs.55,00,000 for providing the job of Data Entry Operator in C.S.P.D.C.L. and he has also taken money from 10 persons, in total he has taken Rs.60,00,000/- and it appears that applicant has taken huge amount from various persons. Further, considering the fact that charge sheet has already been filed in the instant case, therefore, I am not inclined to allow the bail application of the present applicant. 7.
Accordingly, the bail application of the Applicant – Lukeshwar Kumar Sahu, involved in Crime No.33/2025 registered at Police Station Panduka, District Gariyaband (C.G.), for the offence punishable under Sections 318(4), 336(3), 338, 340(2) of the Bharitya Nyaya Sanhita, 2023, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed
4 and conclude the trial expeditiously. 9. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/-
