Petitioner has been made accused in connection with Sessions Trial No. 553 of 2022 arising out of Bankmore P.S. Case No. 307 of 2021 for the offences registered under sections 302, 34 and 120-B of the Indian Penal Code and section 27 of Arms Act, pending in the court of learned Additional Sessions Judge-IV, Dhanbad. 3. Bail application of the petitioner was earlier rejected by a Coordinate bench of this Court vide B.A. 9982 of 2022 by order dated 30.11.2022. 4. On 24.11.2021, petitioner along with the co-accused persons have shot the deceased Md. Mahtab Alam, due to which, he succumbed to his injury. 5. Report regarding the stage of the trial earlier called for, has been received. It appears that the case has been fixed for recording of the defence evidence. 6. Considering the nature of allegation and the fact that the case is at the fag end of its conclusion, I am not inclined to enlarge the petitioner on bail.
