Hon'ble Manoj Bajaj,J. Applicant has filed this application under Section 447 B.N.S.S, 2023 seeking transfer of Case No.3322 of 2023, titled Pradeep Bansal Vs. Dev Suman Goyal, under Section 138 Negotiable Instruments Act, Police Station Quarsi, District Aligarh, pending in court of Judicial Magistrate, Aligarh to any other competent court of jurisdiction at Muzaffar Nagar. Learned counsel for the applicant contends that the nephew of the complainant- opposite party no.2 is working as a clerk in the district judiciary, therefore, he may influence the case proceedings. During the course of hearing, it is not disputed by the learned counsel that in the complaint, the accused- applicant appeared only once i.e. on 23rd July, 2024 when he was extended the concessions of regular bail, and thereafter he never appeared before the trial court, as he has been seeking exemption from personal appearance. Apparently, the application seeking transfer of the case is based on frivolous ground, therefore, this application is hereby dismissed with costs of Rs.10,000/-. The cost to be deposited within one month before the Registrar General, High Court Allahabad, who will, thereafter forward the same to the High Court Legal Services Committee.
