ORAL JUDGMENT Aggrieved by the award passed in MVC.No.6685/2022 dated 19.07.2024 by the II Addl. Judge and ACJM, Court of Small Causes, Bengaluru, the Insurance Company is before this Court questioning the quantum of compensation. The claim petition is filed seeking compensation of an amount of Rs.5,00,000/- for the injuries sustained by the claimant in a road traffic accident. The Tribunal had awarded the global compensation of an amount of Rs.25,000/-.

Learned counsel appearing for the appellant/ Insurance Company submits that the claimant had sustained simple injuries and treated as an outpatient. The Tribunal had considered the nature of injuries, treatment taken in the hospital and considering the pain and suffering by the claimant, the Tribunal had granted the global compensation of an amount of Rs.25,000/-. It is further submitted that the doctor was not examined and nothing has been placed on record. The Tribunal ought not to have granted the global compensation of an amount of Rs.25,000/-.

3. Though notice is served on the respondents, no representation on behalf of the respondents.
4. Having heard the learned counsel appearing for the appellant/Insurance Company, perused the material on record. The Tribunal had considered the injuries, the hospitalization, the pain and suffering, had granted the global compensation of an amount of Rs.25,000/- which is a very minimal amount and this Court finds no reasons to interfere.
5. Accordingly, the appeal filed by the Insurance Company is dismissed. i. The amount in deposit shall be forthwith transferred to the Tribunal. ii. Registry is directed to return the Trial Court Records to the Tribunal, along with certified copy of the order passed by this Court forthwith without any delay. iii. No costs.
