This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.79/2025 registered at Police Station- Rajim, District-Gariyaband (C.G.) for the offence punishable under Sections 74, 296, 351(3), 115(2), 108, 309(4), 3(5) of BNS. 2. Case of the prosecution, in brief, is that the allegation against the applicant herein is that on the date of incident the applicant along with other juveniles abused the deceased Tikeshwar Sahu and VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2025.09.24 10:46:08 +0530 2 Tomeshwari @ Tameshwari Sahu, and intimidated and assaulted them due to which the said persons committed suicide by hanging 3 days after the incident. It is also an allegation that the applicant and his companions have looted a sum of Rs. 20 Lakhs, whereas during investigation, no evidence of loot was found. After information of suspicious death by the father of the deceased, an FIR bearing crime no. 79/25 u/s 74, 296, 351(3), 115(2), 108, 309(4), 3(5) of the BNS was registered against the applicant and the other 2 minors. 3. Learned counsel for the applicant submits that the applicant has not committed any offence and he has been falsely implicated in offence in question. It is further argued by learned counsel for the applicant is that applicant along with two co-accused, who are juvenile abused the deceased namely Tikeshwar Sahu and Tomeshwari @ Tameshwari Sahu, and intimidated and assaulted them due to which the said persons committed suicide by hanging 3 days after the incident. He further submits that there is no prima facie case is made out against the applicant. The applicant is in jail since 06.03.2025, the applicant has no previous criminal antecedent, charge-sheet has been filed and the trial is likely to take some time for its conclusion. Therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State counsel opposes the bail application and submits that the charge-sheet has been filed in the present case and submits that there is one suicide note was found and specific allegation levelled against the present applicant by the two deceased, one is daughter of the complainant and other is a NIece (bahnji) of the complainant. He also submits that mobile phone of deceased also recovered from the possession of the present applicant. 5. I have heard learned counsel appearing for the parties and perused 3 the case diary. 6. Taking into consideration the facts and circumstances of the case, nature and gravity of offence, applicant along with two co-accused, who are juvenile abused the deceased persons namely Tikeshwar Sahu and Tomeshwari @ Tameshwari Sahu, and intimidated and assaulted them, due to which the said persons committed suicide by hanging three days after the incident, specific allegation levelled against the present applicant by two deceased and mobile phone of the deceased also recovered from the possession of the present applicant, looking to the seriousness of the allegations levelled against the applicant, this Court is of the view that the applicant is not entitled to be released on bail in this case. 7. Accordingly, the second bail application of the applicant-Leeku @ Likeshwar Sahu, involved in Crime No.79/2025 registered at Police Station- Rajim, District-Gariyaband (C.G.) for the offence punishable under Sections 74, 296, 351(3), 115(2), 108, 309(4), 3(5) of BNS, is rejected at this stage. 8.
