On 5th December, 2025, this Court passed the following order: “1. In the short affidavit dated 04.09.2025, the Jawaharlal Nehru University (in short 'University") has stated that the calculations sheets of arrears of six pensioners have been completed and for rest the needful shall be done within eight weeks. 2. Even today, the request by the learned counsel for the University is that more time is needed. 3. The eight weeks asked for in the affidavit have already been expired. 4. Let the needful be done on or before 19.12.2025 failing which the Registrar of the University along with the record shall remain present in the Court on the next date of hearing. 5. Put up on 19.12.2026.” 2. Subsequently, on 19th December, 2025, the following order was passed: “1. This matter has been listed on Office Note as an inadvertent typing This is a digitally signed order. The Order is downloaded from the DHC Server on 16/02/2026 at 14:31:57 error occurred in the order dated 05.12.2025 wherein the next date of hearing was typed as '19.12.2026' instead of '19.12.2025'. 2. Learned counsel for respondent no.l submits that the calculations of arrears to be paid are ready in compliance of the affidavit filed on 04.09.2025. The formality of the petitioners giving an undertaking to refund the excess amount if any, remains to be completed, thereafter the payment shall be released. 3. Let the petitioners do the needful within two weeks from today and payments be released thereafter. 4. Put up on 12.02.2026.” 3. From the aforesaid order, it appears that upon computation of arrears, Respondent No. 1 was to release payment to the Petitioners subject to the Petitioners furnishing an undertaking to refund any excess amount, if found payable. The statement of counsel indicates that the release of payment was made conditional. However, Mr. Abhik Chimni, counsel for the Petitioners, submits that all Petitioners have already received their dues and Respondent No. 1 did not insist upon any undertaking. He further submits that, nevertheless, the Petitioners are not resiling from the assurance recorded in the order dated 19th December, 2025 and, in the event any prescribed format of undertaking is communicated, the same shall be duly furnished. 4. In view of the above, since the Petitioners have already received the payment, no further substantive directions are required. In case Respondent No. 1 requires the Petitioners to furnish an undertaking, the particulars thereof may be conveyed to Mr. Chimni, who shall arrange for submission of the same on behalf of the Petitioners to Respondent No. 1. 5.
