Neutral Citation No. - 2025:AHC:53843 Court No. - 9 Case :- MATTERS UNDER ARTICLE 227 No. - 3528 of 2025 Petitioner :- Inder Bir Singh Uppal Respondent :- Smt. Geeta Devi And 2 Others Counsel for Petitioner :- Nidhi Kaushik,Vijay Kumar Sharma Hon'ble Rohit Ranjan Agarwal,J.
1. This is defendant's petition. In the suit instituted by the plaintiffs-respondents, an application for grant of temporary injunction was moved in which the trial Court on 18.03.2025, after recording reasons, had granted an ad interim injunction and further notice was issued to the defendant. The defendant had challenged the order granting ad interim injunction on the ground that notice was not given to him.
2. Proviso to Rule 3 of Order XXXIX C.P.C. provides that in case of urgency, the Court may grant injunction and issue notice to the defendant. From perusal of the order impugned, I do not find any infirmity therein. No interference is warranted in the order impugned.
3. The writ petition stands dismissed.
4. However, in case the petitioner files an objection within a week from today, the Court below shall proceed with the temporary injunction application and decide the same in accordance with law as also considering the objections, if any, filed by the defendant and after hearing all affected parties, within next two months.
