This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “to issue a writ, order or direction more particularly one in the nature of a writ of Mandamus declaring the actions of Respondents 3 to 5 and their subordinates making efforts to acquire the property by dispossessing me without adhering to the due process of law from the agricultural land encompassing an extent of Ac 0-18 cents in the full extent of Ac 1.84 cents in R.S. No. 255 located in Komaragiri Village, I. Polavaram Village and Mandal, Dr. B.R. Ambedkar Konaseema District, Andhra Pradesh for proposed construction of a Sattibalija Community Hall and Such actions are an arbitrary exercise of power, in violation of the principles of natural justice, and infringe upon Article19 and 300A of the Constitution of India and Consequently direct the Respondents 3 to 5 to cease all actions relating to my dispossession and the proposed acquisition of the agricultural land encompassing an extent of Ac 0-18 cents in the full extent of Ac 1.84 cents in R.S. No. 255 located in Komaragiri Village, I. Polavaram Village and Mandal, Dr. B.R. Ambedkar Konaseema District, Andhra Pradesh, without following the procedure established by law….” 2. Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for the respondents. 3. The learned counsel for the petitioner submits that the respondents are attempting to dispossess the petitioner from the subject property admeasuring Ac.1.84 cents in R.S. No.255, situated at Komaragiri Village, I. Polavaram Village and Mandal, Dr. B.R. Ambedkar Konaseema District, Andhra Pradesh, for the proposed construction of a Sattibalaji Community Hall, without following due process of law. Hence, the present writ petition. 4. On the other hand, the learned Government Pleader for the respondents has furnished written instructions dated 04.12.2025 issued by the Tahsildar/3rd respondent, wherein it is stated that there is no proposal on the part of the Government to construct any community hall on the said land. It is further stated that the petitioner is attempting to occupy and enjoy Government poramboke land. 5. The learned Government Pleader also submits that the petitioner and his vendor have filed O.S. No.135 of 2025 before the Court of the Junior Civil Judge, Mummidivaram, seeking injunction in respect of the subject schedule land, and that the same is pending adjudication. It is further stated that the subject property is Government land and that there are disputes between the petitioner and private parties, which are also the subject matter of the pending civil suit. The respondents assert that, in the event of any future requirement, they would act strictly in accordance with due process of law. 6. Considering the submissions made by the learned counsel on either side and upon perusal of the material available on record, this Court is of the considered view that, in view of the written instructions furnished by the respondents and the pendency of the civil suit before the competent Court, and as there is no proposal for construction of any community hall at present, no further adjudication is required in the matter. Accordingly, the writ petition is closed. No costs. Consequently, Miscellaneous Petitions, if any, pending in the writ petition shall stand closed. ________________________ JUSTICE D.
