PUBLIC PROSECUTOR The Court made the following ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A2, seeking regular bail, in Crime No.287 of 2024 of II Town Police Station, Visakhapatnam Commissionerate. 2. A case has been registered against the petitioner herein and others for the offences punishable under Sections 70(1), 77, 2 351(2), 69, 75(1) of the Bharatiya Nyaya Sanhita, 2023 and 67-A of the Information Technology Act, 2000. 3. Case of the prosecution, in brief, is that on 18.11.2024 the de facto complainant gave a report alleging that A1, who is her classmate, developed intimacy with her by promising love and marriage. On 10.08.2024, at Kambalakonda Park, A1 forcibly had sexual intercourse with her, deceitfully reiterating his promise of marriage. On 13.08.2024, at Krishna Gardens, Dabagardens, A1 took her to the rented room of his friend A4 and he again forcibly engaged in sexual intercourse with her. Later, A1’s friends, A2 to A4 arrived to the room and they showed her private videos captured earlier and threatened to share them publicly, if she resisted. Under duress, all four accused sexually exploited her. From that time, the accused continuously harassed and tortured her for sexual favours. Unable to bear the trauma, she attempted to end her life on 18.11.2024 at 04.00 hours. Her father discovered her in distress, and she disclosed the ordeal. Based on the report given by the de facto complainant, the present case has been registered against the accused. 4. Heard. Perused the record. 3 5. A perusal of the material on record goes to show that specific accusations have been made as against the petitioner herein and other accused alleging that they forcibly had sexual intercourse with the victim against her will and thereafter they continuously harassed and tortured her for sexual favours. The offences alleged against the petitioner herein are very serious in nature. Learned Assistant Public Prosecutor submits that investigation is not yet completed and some more witnesses are to be examined. He further submits that if the petitioner is released on bail, he may hamper the investigation and tamper with the material evidence and there is a life threat for the victim in the hands of the petitioner herein and other accused involved in this case. 6. In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner herein/A2 at this stage. 7.
