JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by the petitioner - accused No.1 under Section 482 of BNS praying to grant anticipatory bail in Crime No.222/2025 of Harohalli Police Station registered for offences punishable under Sections 61(2), 318(4), 316(2), 336(2), 340(2) of BNS. 2. Heard learned counsel for the petitioner and learned High Court Government Pleader for the respondent –State. 3. Learned counsel for the petitioner would contend that the petitioner was working in the company of the first informant in the purchase department. The company registered in the name of his wife, namely ‘S.P. Traders’ has supplied materials to the company in which the petitioner was working and payments were made for supply. On coming to know of the supply of materials by a company which is in the name of this petitioner, he has made to quit the job and subsequently, a complaint has - 3 - HC-KAR NC: 2025:KHC:46415 CRL.P No. 14360 of 2025 been made against him for payment without the supply of materials to the company in the name of the company of his wife. He submits that earlier there were transactions those have not been mentioned in the complaint. Whether this petitioner has made payments without supply of materials is a matter of investigation. The petitioner is ready to co-operate with the police in the investigation and abide by conditions to be imposed by this Court. With this, he prayed to allow the petition. 4. Per contra, learned High Court Government Pleader for the respondent -State would contend that the petitioner without supply of materials has made payment to the company of his wife and cheated the company in which he was working. The petitioner is required for interrogation. With this, she prayed for rejection of the petition. 5. Having heard learned counsels, the Court has perused FIR, complaint and other materials placed on record. - 4 - HC-KAR NC: 2025:KHC:46415 CRL.P No. 14360 of 2025 6. The accusation against this petitioner of making payment of the vouchers under which no material has been supplied to the company in which he is working with the help of other accused. The said matter requires investigation. The petitioner is ready to co-operate with the police in the investigation and abide by terms and conditions to be imposed by this Court. The offences alleged against the petitioner are not punishable either with death or imprisonment for life. There are no criminal antecedents of the petitioner. Considering the above aspect, the petitioner has made out case for grant of anticipatory bail with conditions. 7. In the result, the following ORDER i) The petition is allowed. ii) The petitioner is ordered to be released on bail in the event of his arrest in Crime No.222/2025 of Harohalli Police Station subject to following conditions; - 5 - HC-KAR NC: 2025:KHC:46415 CRL.P No. 14360 of 2025 a) The petitioner –accused No.1 shall voluntarily appear before the Investigating Officer within 15 days from this day and execute a bail bond for a sum of Rs.1,00,000/- with one surety for the like sum to the satisfaction of the Investigating Officer. b) The petitioner –accused No.1 shall co-operate with the Investigating Officer in investigation. c) The petitioner –accused No.1 shall not directly or indirectly make an inducement or threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such a facts to the court or police officer or tamper with evidence. d) The petitioner –accused No.1 shall attend the police station whenever called for.
