This criminal misc. application is filed under Section 528 of B.N.S.S. by the petitioners/accused for quashing the summoning/cognizance order dated 08.12.2023 as well as chargesheet dated 05.10.2023 along with entire proceedings of Criminal Case No.1360 of 2023, ‘State vs. Hari Narayan Singh & Ors.’ Under Sections 323, 325, 504, 506, 498-A of IPC and Section 3/4 of the Dowry Prohibition Act pending in the court of learned Judicial Magistrate, Kichha, District Udham Singh Nagar arising out of FIR No.245 of 2022, registered at Police Station Kichha, District – Udham Singh Nagar qua the petitioners, in view of the compromise arrived at between the parties. 1 2025:UHC:2221 2. In view of the fact that a Compounding Application was filed by the parties before this Court, this Court vide order dated 19.03.2025 had directed the parties to appear before the Member Secretary, Uttarakhand State Legal Services Authority, Nainital in order to get their statements recorded and to verify the compromise deed. 3. Pursuant to such order, Member Secretary, Uttarakhand State Legal Services Authority, Nainital has submitted his report dated 19.03.2025 which clearly indicates that the parties have settled the dispute amicably and have also verified the contents of the compromise. 4. In view of the above, Compounding Application (IA No.1 of 2025) is allowed. As a consequence thereof, the entire proceedings of Criminal Case No.1360 of 2023, ‘State vs. Hari Narayan Singh & Ors.’ Under Sections 323, 325, 504, 506, 498-A of IPC and Section 3/4 of the Dowry Prohibition Act pending in the court of learned Judicial Magistrate, Kichha, District Udham Singh Nagar arising out of FIR No.245 of 2022, registered at Police Station Kichha, District – Udham Singh Nagar is hereby quashed qua the 2 2025:UHC:2221 petitioners. 5.
