-BEFORE- HON’BLE MR. JUSTICE KARDAK ETE 07.02.2025 Heard Mr. G. Kato, learned counsel for the applicant and Mr. G. Taloh, learned counsel for the opposite party. This is an application under Section 5 of the Limitation Act, 1963 praying for condonation of delay of 11 days in filing the connected appeal against the judgment and order dated 12.12.2024 passed by the learned District Judge, Yupia in I.A. NO. 87/2024 in MISC (J) No. 01/2024.
Page No.# 2/2 On consideration of the reasons cited for the delay of 11 days in filing the connected appeal, I am of the view that the applicant has been able to show sufficient cause for not filing the connected appeal within the time. Although Mr. G. Taloh, learned counsel for the opposite party has vehemently opposed to the prayer for condonation of delay of 11 days in filing the connected appeal, this Court finds the reasons of delay to be sufficient and germane. Thus, inclined to condone the same. Accordingly, the delay of 11 days in filing the connected appeal is hereby condoned. Interlocutory application stands allowed and disposed of. Registry to list the connected appeal in its usual course.
