In this writ petition, petitioner is praying for mandamus upon the respondents to grant the benefit of compassionate appointment to the petitioner on account of demise of his father, who was an employee under the respondents. 3. Father of the petitioner, namely, Late Ajay Kumar Sinha was an employee under Drinking Water and Sanitation Division, Hatia, Ranchi. He died in harness on 22.11.2022. As per the petition, he was the sole bread earner of the family. Petitioner being the son applied for compassionate appointment. It is his case that no objection was granted by the mother and others. It is the case of petitioner that his date of birth is 19.12.1988. On the date of death of employee, his age would be 33 years and 11 months and today he is of 36 years. 4. Admittedly, the case of the petitioner has not been considered which needs consideration either way. So far as the age of the petitioner is concerned, since the petitioner has applied on 28.12.2023 and at the time of his application, he was nine days over age and at the time of death, he was well within the age limit, I direct the respondents to consider the case of the petitioner sympathetically and pass an appropriate order on his claim. They will also take into consideration Annexure-3, wherein there is provision to relax the upper age limit. They will also consider Annexure-4 series wherein, in some cases, they have already granted the aforesaid relaxation. The petitioner will file a fresh representation annexing a copy of this writ petition within two weeks from today. On receipt of the same, it is expected that the respondents will decide the case of the petitioner considering the document which has been referred to above in this order. The representation should be filed before the Secretary, Drinking Water and Sanitation Department, Government of Jharkhand who will take a decision within four weeks and communicate the same to the petitioner and act accordingly. 5.
