Hon'ble Shekhar B. Saraf,J. Hon'ble Dr. Yogendra Kumar Srivastava,J.
1. Heard learned counsel appearing on behalf of the parties.
2. This is a writ petition under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by the order dated February 15, 2025 passed by the respondent No.3, being the Tehsildar, Tehsil Shikarpur, District Bulandshahr, rejecting the application of the petitioner for issuance of the caste certificate.
3. Upon hearing the counsel appearing on behalf of the parties and perusing the impugned order, we find that the application of the petitioner has been rejected only on the ground of non availability of documents. In the facts and circumstances of the present case, we are of the view that the respondent No.3 should reconsider the application of the petitioner and pass a reasoned order.
4. Accordingly, the order dated February 15, 2025 is quashed and set-aside with a direction upon the respondent No.3 to consider the application of the petitioner once again and pass a reasoned order in accordance with law. In the event certain documents are missing, the respondent No.3 should list out the said documents and inform the petitioner as to what documents are required for the caste certificate. The entire exercise should be completed within a period of six weeks from date.
5. We make it clear that we have not gone into the merit of the claim of the petitioner and it is for the respondent No.3 to take a decision in accordance with law.
6. With the above directions, the writ petition is disposed of. Order Date :- 16.4.2025 Rakesh (Dr. Y.K. Srivastava, J.) (Shekhar B. Saraf, J.) Digitally signed by :- RAKESH MEHTA High Court of Judicature at Allahabad
