Order 16/12/2025 Instant bail application has been preferred under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the petitioners, namely (i) Aarif (ii) Mansed & (iii) Naushad in a case arising out of First Information Report No.340/2025 registered at Police Station Sikari District Deeg for offences punishable under Sections 319 (2), 318 (4), 338, 336 (3), 340 (2), 317 (2), 317 (4), 317 (5), 303 (2), 313 & 61 (2) of B.N.S., 2023 & under Section 66- D of I.T. Act.
Submissions of learned counsel appearing for the petitioners are that the petitioners have falsely been implicated in the present case, they have nothing to do with the alleged offences and they are behind the bars since 26.09.2025. In the present case, impugned F.I.R.
[2025:RJ-JP:50859] (2 of 2) [CRLMB-13694/2025] has been lodged by the Police personnel. The investigation & trial of the case is likely to take a long time to conclude, till then, their further incarceration would not serve any fruitful purpose and they are ready & willing to furnish their bail bonds. Therefore, the bail applications deserve to be allowed. Learned Public Prosecutor for the State has vehemently opposed the bail application. Heard learned counsel appearing for the accused-petitioners as well as the learned Public Prosecutor for the State and perused the material made available on record. Considering the overall facts & circumstances of the case and the submissions made at bar but without commenting upon detailed merits of the case, this Court deems it proper to enlarge the petitioners on regular application. Accordingly, the bail application under Section 483 of B.N.S.S., 2023 is allowed and it is, hereby, ordered that the accused- petitioners, namely (i) Aarif s/o Suleman, (ii) Mansed S/o Samaydeen & (iii) Naushad S/o Abbas shall be enlarged on bail, if they are not required in any other case, provided they furnish a personal bond in the sum of Rs.50,000/- (Rs. Fifty Thousand Only) with two sureties of Rs.25,000/- each to the satisfaction of the ld. trial Judge for their appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
