2. Petitioner has been made accused in connection with S.T. Case No. 152 of 2025 arising out of Chandil P.S. Case No. 57 of 2025 corresponding to G.R. No. 309 of 2025 for the offences registered under sections 329 (3), 308(3), 109, 324(4) and 311 of the Bharatiya Nyaya Sanhita, 2023 and section 25(1-B) (a), 27 and 35 of Arms Act, pending in the court of learned Additional District Judge at Chandil.
3. On 05.05.2024 , dacoity was committed in the medical shop of the Informant. Accused persons fired at the Informant. However, he had a providential escape.
4. It was submitted that the petitioner is neither named in the FIR, nor he was put on the T.I. Parade. It was further submitted that nothing incriminating has been recovered from the possession of the petitioner. It was finally submitted that similarly situated co-accused persons have been granted bail by this court earlier.
5. Learned A.P.P has opposed the prayer for bail and submitted that one country made pistol was recovered from the possession of the petitioner/
6. In view of the submission made above, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Additional District Judge at Chandil in connection with S.T. Case No. 152 of 2025 arising out of Chandil P.S. Case No. 57 of 2025 corresponding to G.R. No. 309 of 2025.
