Both the parties have filed the compromise petition under Order XXIII Rule 3 of CPC. The total extent of the land is 5 acres 12 guntas, which is morefully shown in the compromise schedule. In terms of the compromise, the appellant is entitled for 3 acres of land, out of 5 acres 12 guntas and the respondent is entitled for 2 acres 12 guntas. In the compromise petition, it is also mentioned that if both the parties intend to sell the property to a common purchaser, in that circumstance, both of them will receive the amount proportionately to the extent what they have agreed in terms of this compromise.
